Preston and Hofelich (2012) suggested that researchers disagree on the role of self–other overlap in empathy due to a failure to differentiate among neural overlap, subjective resonance, and personal distress; they also developed a framework for tying neural and subjective overlap to various aspects of functioning they include in the construct of empathy. Although we found their discussion of different processes that have been labeled empathy interesting and helpful, we found their discussion of self–other overlap to be somewhat less useful (...) for conceptualizing differences among empathy-related processes. In addition, we provide an alternative perspective to their reasoning regarding the role of experience and neural overlap in an aspect of empathy-related responding (e.g., concern or compassion). This article analyses the development of the subjective concept of rights amongst Jesuit missionaries in Brazil during the sixteenth century, in the context of their cultural encounters with the Tupi Indians, and the ensuing debates over the justification of the natives' voluntary slavery. Usually associated with Hugo Grotius' natural law theory, the subjective concept of rights was originally developed by Jesuit theologians in Portugal, and justificatory practices in the missionary enterprise overseas formed the context in which this concept became current (...) within the Society of Jesus. Why is it that most among the relatively few moral philosophers since Kant who, like J. S. Mill, have discussed the question whether there can be moral duties to oneself, have answered it negatively? One reason is that those philosophers have supposed that all moral action must be, inter alia, social; and they may have thought so because of their commitment to what is here called a 'corporationist' moral view. But such a conception of morality as social is objectionable because (...) it does not square with ordinary opinion and because it introduces an artificial division between types of action which go together in real life. In this paper, we define the family FiCn:={FiCn}n∈ω of logics by means of semantics of bivaluations. This family is a variant of the family of paraconsistent bivaluated Ciun-logics, defined and studied by J. Ciuciura. We will show that every logic in FiCn can be alternatively defined by means of finite matrices. This result arises from the characterisation of the truth-values of the involved matrices (relative to each FiCn-logic) as being specific finite sequences of elements of the set 2 := {0,1}. (...) Religious individuals often assume that their beliefs promote strong romantic relationships. Yet the empirical evidence is mixed. To better understand this association, this study examined religious orientation as a moderator within the investment model of commitment. A community sample of 84 couples completed measures on religious orientation and commitment as part of a larger study on romantic relationships. The findings indicate that although both religious motivations promote commitment, they do so differently. Specifically, intrinsic religious orientation buffered the negative effects of (...) dissatisfaction in a relationship; whereas an extrinsic religious orientation attenuated the extent to which alternatives to the relationship influenced commitment. Future research in this area should consider religious orientation, rather than overall religiosity, and examine specific predictors of relationship commitment to provide greater clarity on how religiosity influences romantic relationships. Implications for counseling individuals with religious beliefs are also discussed. (shrink)

There is a concern that physicians/researchers are inappropriately profiting from information derived from advance copies of high-impact clinical trial data distributed by medical conferences or journals. Despite these concerns, it has never been systematically evaluated, and little is known about the degree to which it exists. This is largely due to difficulties associated with directly verifying whether or not such activities have taken place and, furthermore, many medical conferences/journals today have taken the necessary actions to guard against this. One medical (...) association in particular, the American Society of Clinical Oncology, only began responding to such concerns several years ago. What accounts for the continued lack of clarity over the legal procedures for the patenting of DNA sequences? The patenting system was built for a "bricks-and-mortar" world rather than an information economy. The fact that genes are both material molecules and informational systems helps explain the difficulty that the patent system is going to continue to have.

One hundred and ninety‐six Israeli middle‐school students participated in a study that explored the effects of moral orientation (moral versus conventional)and of three situational variables on attitudes toward two types of cheating in school exams—copying from others (‘active’)and letting others copy (‘passive’). Several vignettes that were comprised of different combinations of the three situational variables—exam importance, supervision level and peers' norms—were used as the main instrument. It was found that a‐morally oriented students approved significantly more of cheating than morally oriented (...) students. Importance of exam had marginally significant effects on active copying. Level of supervision during exam and classmates' norms had significant effects on both active and passive cheating attitudes. (shrink)

Religious associations sometimes seek to provide services and goods to the public using religious values that discriminate on grounds otherwise prohibited by law and public values. 'Group pluralists' support these efforts by highlighting the importance of shielding group authority from state overreach and protecting a robust associational life within democratic contexts. By contrast, 'liberal statists' insist on the state's final authority over societal groups and the need to protect individuals from arbitrary group power. This paper defends a third approach to (...) group authority called relational pluralism. Relational pluralism is skeptical that the state can resolve group conflicts fully and fairly and recognizes that too much state interference in group life weakens democratic relations. At the same time, it recognizes that groups can rarely act independently of other groups, including the regulatory state. Instead, groups rely on being empowered by other groups and often also by the state to carry out their projects. Group authority is nearly always 'relational' in that it depends on the cooperation of other groups. The paper sketches out a relational pluralist approach to understanding group authority and explains its democratic virtues. It shows how the approach can illuminate otherwise underappreciated features of conflicts about authority. (shrink)

Three key contributions of Iris Young to democratic political theory, and three challenges that have arisen in response to Young's theory, are examined here in relation to education. First, Young has argued that oppression and domination, not distributive inequality, ought to guide discussions about justice. Second, eliminating oppression requires establishing a politics that welcomes difference by dismantling and reforming structures, processes, concepts and categories that sustain difference‐blind, impartial, neutral, universal politics and policies. The infatuation with merit and standardized tests, both (...) of which are central to measuring educational achievement, are chief amongst the targets in need of reform. Third, a politics of difference requires restructuring the division of labour and decision‐making so as to include disadvantaged social groups but allow them to contribute without foregoing their particularities. The challenges that have arisen in response to Young's theory are first, that difference is merely another way of getting at inequality of resources or opportunities, and if it is not, then, second, a politics of difference values difference for the sake of difference rather than for the sake of alleviating social disadvantage. Third, in theory and in practice a politics that focuses on difference putatively jeopardizes a politics whose aim is to improve the redistribution of resources. (shrink)

Abstract:In this manuscript, we start with a real life account of an Ob/Gyn experience with a young patient from the childfree movement requesting permanent sterilization. A narrative ethics approach invites the reader to experience the encounter in an immersive way for this growing issue. This approach allows readers to reflect on their reaction to the patient and consider how that can affect other patient encounters. Additionally, it explores the stigma these young patients encounter making a permanent decision to never have (...) children. In the commentary, we explore the ethical issues in this case including why we question the permanent decision to refrain from having children. We also discuss informed consent and patient education along with the various approaches to physician-patient relationships with an emphasis on shared decision making, which allows space for both patient and physician to question and reason through their health decisions. The infant's first natural response when faced with opposition or when he opposes others' actions is to cry. As this kind of behavior becomes ineffective, the responses of the individuals with which he interacts force him to adopt more conventional — especially verbal — patterns of arguing, leading him to rational argumentation. The purpose of the present paper is to observe progressions in children's earliest verbal arguments and to see how and when they learn to adjust their strategies for different (...) kinds of opponents (peers; parents; other adults). In order to examine the emergence of such persuasive strategies, and their distribution according to the different categories of opponents, systematic audiotape recordings of two Spanish-speaking girls between 2 and 3 years were analyzed. The data suggest that, although there were some differences in how the girls argued with parents versus peers, they were only beginning to adjust their speech to make it appropriate for one or the other type of listener. In general, they resorted to one dominant strategy for all listeners (insist, repeat, cry, scream, ...). Each girl, however, developed a small number of less frequently used strategies that she reserved for a subcategory of opponents. For example, one of them, Nancy, only threatened and insulted peers, while the other, Marisa, only used “please” and a temporizing strategy with parents. The girls used less adaptive, more agressive strategies (e.g. threats and insults) with their peers. With one exception, all of the girls' moves were self-centered. This article draws together two works created in late fifteenth-century Mantua. Although radically different in kind, they were borne from the same acts of violence: Andrea Mantegna’s Madonna of Victory and a responsum about Jewish religious law by Rabbi Joseph Colon. Mantegna’s altarpiece, painted to commemorate the bloody battle of Fornova as a Gonzaga victory, was paid for by Daniele Norsa; Norsa, a Jewish banker, was accused of destroying a prior Christian icon and ordered to finance the new altarpiece as (...) reparations for this crime, under threat of death. Colon’s responsum addressed the permissibility of creating a Christian image under duress—idolatry being one of the sins for which a Jew must sacrifice their life rather than transgressing. We explore the remarkable artistry and distinct craft practiced by the painter and the rabbi—image making in the one case, legal reasoning in the other—as modes of describing, interpreting, and creating reality. Both works address problems of religion and idolatry, faith and coercion, victory and violence, and triumph and lament. Together they reveal the dynamics of a fascinating iconoclash, a conflict of culture waged over the struggle between making and breaking images. (shrink)

The emphasis on innate talent as the basis for outstanding achievement underestimates the importance of hard work. Learned industriousness helps supply the sustained effort required for superior achievement. The goal of having a productive, well-educated citizenry can be furthered by rewarding students for high effort and attending carefully to their individual educational needs.

Rachlin's hyperbolic-discounting model captures basic features of the subtlety of human impulsiveness and self-control and has received convincing experimental support. His distinction between self-control patterns and impulsive acts expands his earlier work to a greater range of self-control behaviors. Possible mechanisms that may weaken or strengthen patterns of self-control are considered.

The law values fairness, proportionality, and predictability. Accordingly, in the context of criminal law, punishments should be carefully calibrated to reflect the harm caused by an offense and the culpability of the offender. Yet, while this would suggest the dominance of “smooth” input/output relationships—for example, such that a minuscule increase in culpability would result in a correspondingly small increase in punishment—in fact, the law is laden with “bumpy” input/output relationships. Indeed, a minuscule change in input (be it of harm, culpability, (...) or any number of other measures) may result in a drastic change in output, creating significant discontinuities. Leading scholars have argued that smooth input/output relationships, which feature careful gradation and calibration, better accord with dominant theories of punishment than do bumpy relationships, which lack fine-tuning. Accepting as a starting premise that smooth input/ output relationships are to be preferred in the criminal law, this Article focuses on the significant doctrinal and practical impediments to smoothing out these relationships. This analysis reveals challenges to smoothing out relationships between inputs and outputs, as well as the difficulties associated with addressing discontinuous relationships among inputs and outputs. Specifically, it exposes the law’s classification of inputs and outputs itself as contestable and responsible for a range of hard-to-resolve discontinuities. In doing so, this Article begins the task of laying the groundwork for further analysis and possible reforms. (shrink)

Group Pluralism versus Group Accommodation In this paper, I sharply distinguish between religious group-based pluralism and religious accommodation, which are each reflected in the cases examined in Jean Cohen’s paper and thereby provide a clearer understanding of different kinds of challenges to protecting religious freedom today and explain how these two approaches sometimes pull interpretations of religious freedom in different directions.

This study examines John Stuart Mill’s philosophy of history and his efforts to develop a comprehensive methodology for the social sciences. The author argues that Mill’s interpretation of history and his conception of cultural and economic stationary states were central to his critique of mass culture and his advocacy of individual autonomy.

There are two central distinctions upon which the present argument is predicated. First is the distinction between two correlative aspects of what is involved in a value-judgment or in an “experiencing” of value: actualized-value and value-ideal. This we find to be a distinction without which all attempt at clear talk about “value” is so hopelessly ambiguous as to be unintelligible. Second is the distinction between property-platonism and platonism-proper. After these two sets of distinctions have been explicated, our thesis will be (...) pursued: Moore is not a value-platonist-proper at all, because his famous “non-natural” property, goodness, is not a value-ideal. Contract law doctrines can be ranged along various spectra. One of these spectra runs from the static to the dynamic. A contract law doctrine lies at the static pole of this spectrum if its application turns entirely on what occurred at the moment in time when a contract was formed. A contract law doctrine lies at the dynamic pole if its application turns in significant part on a moving stream of events that precede, follow, or constitute the formation of a (...) contract. Another spectrum runs from the binary to the multifaceted. Contract law doctrines are binary if they organize the experience within their scope into only two categories. Contract law doctrines are multifaceted if they organize the experience within their scope into several categories, including one or more intermediate categories. Classical contract law was a rigid, rather than a supple, instrument. Its rules were often responsive to neither the actual objectives of the parties, the actual facts and circumstances of the partiesâ transaction, nor the dynamic character of contracts. Instead, the rules of classical contract law were centered on a single moment in time, the moment of contract formation. accordingly, classical contract law doctrines were almost wholly static and also tended to be binary. The twentieth century witnessed the development of a modern contract law that has largely overthrown classical contract law. This overthrow has occurred in two ways. To begin with, in many cases modern contract law has reversed or fundamentally modified the rules of classical contract law. More important than the overthrow of specific rules of classical contract law, however, has been the overthrow of the deep structure of classical contract law. Where classical contract law had an overriding preference for rules that were objective and standardized, modern contract law has been highly flexible in adopting rules that are individualized and even subjective. Where classical contract law rules were typically binary, modern contract law rules are often multifaceted. Finally, where classical contract law was largely static, modern contact law is, in large part, dynamic. So, for example, static rules of interpretation have been replaced by dynamic rules that take into account events before and after the moment of contract formation; the static legal-duty rule has withered almost completely away, to be largely replaced by a dynamic modification regime that takes into account the value of ongoing reciprocity; a static judicial review of liquidated damages provisions is giving way to a dynamic review that takes account of the actual loss; and static offer-and-acceptance rules have been replaced by dynamic rules, such as the duty to negotiate in good faith. Various philosophers have already written articles about what might be called the philosophical lessons to be derived from James’s tales and novels. Showing a close acquaintance with those articles as well as with recent literary studies of James’s work, Pippin, the author of several earlier books concerned with modernity or with modern philosophical texts, has here produced a book which is at once a detailed and subtle interpretation of several of James’s most famous fictional works and also the presentation of (...) an explicit philosophical view about “modern moral life” that appears to be adumbrated in those fictions. That view is that in the modern world, where fluid relationships based ultimately upon money or the lack of it have undermined traditional authority, the possibility of a meaningful life for oneself turns out to require appropriate recognition of others in what amounts to a continuing dialogue, one in which the meaning of one’s own intentions, desires, and attitudes is dependent, in large part, on what others “make” of them and on how they respond, while at the same time one’s response to others is importantly determinative of who they are and of what they mean or meant. Expressed differently, the view is that there are, at least in the modern world, no social—and, indeed, no moral or psychological— facts, but only at best mutually supportive interpretations, each the product of a person’s self-reflections and of one’s responses to the reflections of that person in others. Pippin, however, is not directly concerned to defend the latter view, although it seems clear that he regards it as at least fundamentally correct. His principal concern, rather, is to defend, through his careful readings of various of James’s works, the thesis that that view is implicit in such great works of James’s as The Portrait of a Lady, The Ambassadors, The Wings of the Dove, and The Golden Bowl. In a related way, Pippin takes James’s wonderful stories about ghosts or about secret truths to be concerned with modern persons who, despite their modernity, are committed, even if not in a wholly conscious way, to the existence of real social or moral facts of the matter. The two extant works of Constantine the Philosopher of Nicaea reveal a late twelfth century thinker of the Neoplatonic sensibility typically seen only in those who reached the pinnacle of Byzantine literacy during this period. We argue that he is of particular interest because he coined two philosophical terms that, while mirroring controversial Neoplatonic concepts, better accommodate their Orthodox acceptance.We offer here some background on the author, a short discussion of the philosophical content of these works, and for the first (...) time an English translation of both texts. One of the distinctive features of the primate genome is the Alu element, a repetitive short interspersed element, over a million highly similar copies of which account for >10% of the genome. A direct consequence of this feature is that primates' transcriptome is highly enriched in long stable dsRNA structures, the preferred target of adenosine deaminases acting on RNAs (ADARs), which are the enzymes catalyzing A‐to‐I RNA editing. Indeed, A‐to‐I editing by ADARs is extremely abundant in primates: over a hundred (...) million editing sites exist in their genomes. However, there are few essential editing sites conserved across mammals that have maintained their editing level despite the radical change in ADAR target landscape. Here, we review and discuss the cost of having an unusual amount of dsRNA and editing in the transcriptome, as well as the opportunities it presents, which might have contributed to the accelerated evolution of the primates. It is shown that the application of the Lax-Phillips scattering theory to quantum mechanics provides a natural framework for the realization of the ideas of the “Many-Hilbert-Space” theory of Machida and Namiki to describe the development of decoherence in the process of measurement. We show that if the quantum mechanical evolution is pointwise in time, then decoherence occurs only if the Hamiltonian is time-dependent. If the evolution is not pointwise in time (as in Liouville space), then the decoherence may occur (...) even for closed systems. Although ethics is an essential component of undergraduate medical education, research suggests current medical ethics curricula face considerable challenges in improving students’ ethical reasoning. This paper discusses these challenges and introduces a promising new mode of graduate and professional ethics instruction for overcoming them. We begin by describing common ethics curricula, focusing in particular on established problems with current approaches. Next, we describe a novel method of ethics education and assessment for medical students that we have devised, the Medical Ethics (...) Bowl. Preston & de Waal minimized differences among constructs such as empathy, sympathy, and personal distress. However, such distinctions have been shown to relate differently to altruistic behavior. Moreover, although the authors discussed the role of regulation in empathy, they did not consider the possibility that sometimes empathy is not well-regulated and likely leads to personal distress rather than sympathy.

This interdisciplinary, social scientific analysis of the regulatory discourse on nanotechnology in the three German-speaking countries of Germany, Austria and Switzerland and in the EU between 2000 and 2013 has shown three distinct phases, characterised by shifts in the configuration of actors and in the thematic scope from nanotechnology to nano-materials. Compared to modes of governance based on traditional statutory law, modes of governance based on less binding forms of soft law and self-regulation (like codes of conduct, guidelines and certification (...) systems) and new modes of governance (like assessment studies, risk management frameworks as well as participatory and cooperative forms of communication and negotiation) have gained importance. Despite some similarities, two different cultures in governing nanotechnology can be distinguished: a product-oriented culture in statutory regulations (when speaking about products, the article is also referring to substances) and a risk-based culture in applying soft law based on new modes of governance. In addition, the different regulatory cultures have led to four strategic approaches: modes of governance mainly based on hard law and soft law at the EU level, modes of governance mainly based on cooperative and self-regulatory approaches in Germany, cooperative governance approaches in Austria and modes of governance mainly based on self-regulatory and soft law approaches in Switzerland.
